Any references to “we”, “us”, “our” or “Rossi Boots” are references to Rossi Boots Pty Ltd and its related entities as applicable. These terms and conditions (Terms) govern your use of this Website and apply when you tag us in social media, and must be followed by you. Rossi Boots reserves the right to modify, amend or update these Terms at any time without prior notice. We suggest you regularly check this page to ensure you are aware of the most recent Terms.

By using the Website, including to place an order for products, and continuing to access the Website, and by visiting our stores or tagging us on social media, you consent to and agree to these Terms.

Use of the Website

Rossi Boots does not warrant continuous access to the Website and will not be liable if the Website is unavailable to you due to Website downtime attributable to malfunctions, upgrades, preventative or remedial maintenance activities, interruption in telecommunications supply or otherwise.

Content and Intellectual Property

All content and materials used on the Website, including trade marks, brands, style names, designs, photos, images, video, audio, text, layout, copyright works, software (Intellectual Property) is owned or licensed by Rossi Boots. User Generated Content

By tagging us in images and content you post on social media or other online platforms, you consent to us reposting and sharing your content via our social media channels including, but not limited to, Instagram, Facebook, Twitter, Snapchat and Pinterest.

You must not tag us in any social media posts which are, or which contain, content which is defamatory or otherwise unlawful, harassment, bullying, threatening, abusive or obscene.

User Comments, Reviews, Feedback & Submissions

While Rossi Boots strives to provide accurate product descriptions and pricing information, errors may sometimes occur. We do not represent the accuracy or completeness of any information on the Website and are not responsible for any errors, omissions, or defects.

We have made every effort to describe the products and to display the colours of products that appear on the Website as accurately as possible. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.

Order and acceptance

By placing an order via our Website, you are making an offer to purchase the selected products in accordance with these Terms. An order is not accepted by Rossi Boots until you receive a confirmation email. We may require additional verification or information from you before accepting an order.

Once your order has been placed, it immediately starts going through our ordering process and cannot be cancelled or amended even if it has not been shipped. Once you receive your order, you may return any products by following our returns guide.

We reserve the right to not accept an order, or to cancel an order, for any reason up until the time you accept delivery of the products.

If an order is unable to be fulfilled after acceptance for any reason (for example insufficient quantities), the order will be cancelled and your payment refunded. We will contact you as soon as possible to advise of this.

Prices and payment

Payment can be made by the methods shown at checkout which may include:

2. AfterPay;
3. PayPal

and other payment methods as may be made available from time to time. We use a third party to process payment for online purchases.

All credit card payments are subject to verification and fraud checks by an external fraud prevention provider. We may require additional verification or information from you before accepting an order.

Where AfterPay or PayPal or other third party payment methods are used for payment, the terms and conditions of each of those providers may also apply to your payment, in addition to these Terms. You are responsible for ensuring compliance with any applicable third party terms.

You must not pay, or attempt to pay, for any purchase via fraudulent or unlawful means.

Taxes and duties

The prices for all products on the Website are in Australian dollars and are inclusive of Australian Goods & Services Tax.

Use and quantities of products

Products purchased on the Website or in store are for personal use only. You are not permitted to purchase products on the Website or in store for the purpose of re-sale or distribution.

Rossi Boots reserves the right at its sole discretion, to limit the quantity of items purchased per person, household or per order. This may include restricting quantities of orders placed by the same Rossi Boots account, same credit card and to customers using the same billing or mailing address.

We will endeavour to provide notification to the customer should such restrictions be applied.

Risk and title

Title to products ordered on the Website passes to you upon delivery. All risk of loss or damage to the products ordered by you passes to you when we dispatch your product from our premises, or in the case of electronic gift cards, when the electronic transmission containing the electronic gift card leaves our server.

Shipping and delivery

Once your order has been accepted, products will be despatched from our warehouse within 5-10 Business Days. Please also note that circumstances beyond our control may mean that despatch could take longer in some cases.

Please allow 5-15 days for standard delivery by Australia Post within Australia, and longer for international delivery. As delivery services are carried out by a third party, once the products have been despatched, we are not liable for the products and cannot guarantee delivery times. There are matters beyond our control, and in some cases beyond the control of the carriers, that may impact delivery times.

Shipping costs are the responsibility of the customer unless otherwise stated and are shown on the checkout page.

Guarantees and care for our products

Rossi Boots products incorporate the highest standards in materials, technology, and experience, aimed at giving the wearer the maximum protection possible.

Under the Australian Consumer Law, when you buy our products they come with automatic guarantees that cannot be excluded. If the product you have purchased has a fault or is not of acceptable quality under the Australian Consumer Law, Rossi Boots will arrange for a repair, refund or replacement in accordance with the law. More information about our return process is below.

For ROSSI BOOTS customers, please note: HYDROLYSIS is the chemical breakdown of polyurethane (PU) due to reaction with moisture/ water. It is gradual absorption of moisture over time causing the soles to deteriorate from the inside out. As the PU gets harder and more porous, the sole can start to crumble. This is not considered a manufacturing fault with our product; it is a property of PU. Hydrolysis can be avoided by regular wear and proper care of your boots. Do not store your boots in dark, unventilated areas (including shoe boxes) for long periods of time.

LEATHER is a natural organic product and will always perform, wear and age a little differently. Always dry wet footwear at room temperature away from direct sunlight and follow the Rossi Boots leather care guidelines when cleaning and treating your boots.

Refunds and Exchanges

You may seek a refund or exchange to the value of the purchase price for any product purchased on the Website or in store (excluding gift cards) subject to the below. To seek a refund or exchange:

1. return the product unworn within 60 days of purchase for full price products, or within 28 days for sale or clearance products;
2. the product must be in its original condition;
3. all original tags and labels must still be attached to the product;
4. the original Rossi Boots tax invoice must be provided as proof of purchase.

Please follow the following procedure:

For products purchased online received at an Australian address:

• Complete the returns form that you received with your order, or download a new form:

• Use our Australian Post portal to lodge and print your free return and receive your postage label – click here
• Pack your product for return, include your form and place the label on the box/satchel
• For Australian customers - post in a red post box or take to the post office

Products purchased online can also be returned in store, except for products which were purchased using PayPal or Afterpay which must be returned via the online procedure above.

For online purchases received outside of Australia:

• Complete the returns form that you received with your order, or download a new form:

International customers are responsible for return postage and any costs associated with the return.

For products purchased in store:

• Take your item to any Rossi Boots store in Australia – for a list of stores go to our Contact page
• Rossi Boots is not responsible for any products lost or damaged in transit.

Once your return product has been received by Rossi Boots, it will be assessed for compliance with this policy. If the return is approved:

Exchange – your exchange will be processed within 5-10 Business Days or immediately if returned to store.

Refund – if a refund is to be provided, your refund will be processed within 10 Business Days of approval of the return or immediately if returned to a store. Please note that if you purchased your product via credit card, it may take up to 5 Business Days for the refund to appear on your credit card statement.

Faulty product - If your product has a fault, please contact us directly on 1300 727 355 to arrange your return directly.

The Australian Consumer Law guarantees cannot be excluded by law. If the product you have purchased has a fault, Rossi Boots will arrange for a repair, refund, or replacement in accordance with the law.

Indemnification

You agree to defend, indemnify and hold harmless Rossi Boots and its related entities, affiliates, employees, directors, agents and contractors from and against any and all claims, loss, damage, costs, expenses (including legal fees), arising from or related to your use of the Website, communications with us, or any breach of these Terms by you.

Applicable law

These Terms are governed by the laws of the state of Victoria, Australia. Any action or proceeding arising out of or related to these Terms or your use of this Website must be brought in the state courts of Victoria and you consent to the exclusive jurisdiction of such courts.

As the Website can be accessed throughout Australia and overseas, we do not represent that the Content complies with the laws of any country outside Australia or that any competition, offering or Content accessible through the Website is appropriate or available for use in locations outside Australia. If you access this Website from outside Australia, you do so at your own risk and responsibility, and are responsible for making sure you comply with all applicable laws in the place you are located. You are not authorised to access the Website from any location where doing so would be illegal.

You understand that some countries have import restrictions on certain goods or materials. If you are outside Australia you will become the importer and will be liable to pay local taxes or duties, and you will assume all liability under any customs or import laws and regulations.

To the maximum extent possible under law, Rossi Boots, its related entities, affiliates, directors, employees, agents, contractors, successors and assignees, exclude liability for any demands, loss, damages, loss of data, loss of reputation, loss of revenue, proceedings, fines, penalties or other claims against you relating to your use of the Website, your purchase of products on this Website, or any other matters covered by these Terms or your dealings with Rossi Boots.
